Daniel S. Smith joined the firm's litigation department in 2017. In 2010, Daniel earned a Bachelor of Science in Business in Administration from the University of North Carolina at Chapel Hill. While enrolled at UNC's Kenan-Flagler Business School, Daniel concentrated on international business and attended the Chinese University of Hong Kong as an exchange student. His passion for the law led him to the University of Florida's Levin College of Law where he received a merit scholarship and was a member of the Florida Journal of International Law. During law school, Daniel served Miami-Dade's then-only complex business litigation judge. and worked as a summer associate for a prominent firm with offices throughout Florida. More recently, Daniel was an associate for several years at a national law firm representing Fortune 500 companies, governmental entities, community associations, small businesses, and individuals in a diverse multitude of legal issues from pre-suit through trial. Daniel was born and raised in Miami Beach.

Daniel handles complex civil litigation in both state and federal court. His practice areas in the past has included disputes involving internal corporate governance, professional misconduct, defamation, employment law, condominium and community association law, construction defects, real estate, intellectual property, insurance coverage interpretation, appeals, and personal injury and wrongful death.

Representative Experience

  • Frequently litigated and resolved discrimination, harassment, retaliation and other claims against employers, obtaining summary judgment in federal court on behalf of an employer in a retaliation lawsuit.
  • Frequently litigated and resolved high exposure insurance coverage disputes both pre-suit and via declaratory actions and/or breach of contract lawsuits, including the preparation of numerous coverage opinions for insurance companies relating to exposure emanating from consumer products, professional malpractice, and other commercial risks.
  • Assisted in the Florida Department of Financial Services' multi-million-dollar trial alleging malpractice against a "Big-4" accounting firm.
  • Obtained dismissal with prejudice of lawsuit asserted against publicly-traded online entity based upon the Communications Decency Act.
  • Taken and defended numerous depositions involving real estate development disputes, construction defects, premises liability, and community association operations.
  • Conducted investigations underlying catastrophic injury claims, including shooting incidents, vehicular accidents, and other tragedies.
  • Successfully resolved numerous lawsuits involving alleged violations of state and federal statutes, including RICO, deceptive and unfair trade practices, consumer collection practices, the Magnuson-Moss Warranty Act, and laws relating to the modification of insurance coverage.
