Ailyn Popowski is a partner in the firm's Litigation Department. She focuses her practice on complex commercial litigation, employment law, and mass torts, including class actions. Ms. Popowski earned her Bachelor of Arts Degree from the University of Florida in 1987 with Honors and her Juris Doctor degree from the University of Miami in 1991.

Ms. Popowski has represented clients - both individual and corporate - in a wide array of complex civil litigation, both in state and federal court, as well as multi-district litigation. In 2014, Mrs. Popowski, along with Mr. Diaz, handled and obtained a $164 million dollar judgment - the largest in South Florida history - after a prolonged and complex civil litigation battle spanning three courts, multiple states and ten interlocutory certiorari petitions and appeals. The judgment was paid and remains one of the largest, collected foreclosure judgments in South Florida history.

Ms. Popowski is admitted to practice before the Southern District of Florida and is a member of the American Bar Association and the Cuban American Bar Association.

Representative Experience

  • Representation of private sector employers in discrimination, harassment, and retaliation cases.
  • Member of litigation team who obtained $164 million dollar judgment on behalf of special purpose entity, lender and special servicer for Commercial Mortgage Backed Securities (CMBS).
  • Secured favorable multi-million dollar jury verdict, including punitive damages in a products liability trial involving international defendants for damages arising out of defective drywall products manufactured in China.
  • Member of the litigation team who successfully obtained favorable settlement for publicly traded corporation in a multi-million dollar Directors and Officers' Liability Insurance coverage dispute.
  • Member of the litigation team who successfully obtained favorable settlement for real estate developer in a multi-million dollar consumer finance litigation instituted by lender in federal court.
  • Represented hundreds of property owners in state and federal individual and class action products liability litigation against builders, installers, realtors, suppliers, and manufacturers ultimately resolving a billion dollar class action settlement.
  • Member of litigation team in class action against lending institutions for deceptive practices related to improper overdraft fees.
  • Member of litigation team representing over 5,000 Latin American investors in a securities fraud class action.
  • Member of litigation team representing 34,000 investors in a class action arising from the Ponzi scheme orchestrated by a Corporation and its executives.
  • Member of litigation team representing victims and their families in numerous wrongful death and personal injury actions arising from commercial aviation disasters.
